Before India Exports Digital Public Infrastructure, It Should Define It at Home

India is actively engaging in the export of its Digital Public Infrastructure (DPI) frameworks to other countries while facing significant challenges in defining and regulating DPI within its own borders. Despite signing cooperation agreements with at least 24 nations, India lacks a clear statutory definition of DPI, which raises concerns about accountability and data protection. Defining DPI is crucial for establishing legal frameworks that ensure accountability, protect personal data, and clarify the responsibilities of DPI operators. Without a clear definition, systems operating at a population scale may evade necessary safeguards, leading to potential misuse of personal data and lack of transparency. As India expands its digital infrastructure partnerships in Latin America, the absence of a clear legal framework for DPI could impact how countries in the region assess and adopt Indian technologies, potentially leading to governance challenges similar to those faced domestically in India.
